What are the possible penalties for filing a false police report in Michigan ??

I have been told that it is a misdemeanor.


A member of my family (who is also mentally disabled under Social Secufity Disability) filed a police report when they said their identity was stolen when in fact they just panicked when they mishandled their own money


The ';general'; answer I got from a police person was that it is a misdemeanor and they were taken in to police station not charged with anything but photographed and fingerprinted and sent home saying that they would be ';contacted'; by mail by the state


I would appreciate any help here as to whether this was usual and what to do to help this family memberWhat are the possible penalties for filing a false police report in Michigan ??
Filing a false report of a misdemeanor is punishable by not more than 93 days in prison, or a fine of not more than $500.00, or both. Having said that, however, it's very unlikely that your family member will go to jail for 93 days and will have to pay $500.00. It's all up to the District Attorney handling the case. I'm betting he/she may have to pay a fine and may get probation. And yes, it's not unusual for someone in a situation like this to be taken down to the police station and photographed and fingerprinted but not incarcerated. The police have the option of releasing you in cases where the alleged offense(s) do not make you an immediate risk to the public. Lying about identity theft doesn't make you dangerous, but assaulting someone or driving while drunk does -- see the difference?What are the possible penalties for filing a false police report in Michigan ??
Better hire a Lawyer because the cops can change the story and the rules any time. This person should have hired a Lawyer before making any statements to police. Get a Lawyer now.
