Can you file counter charges if some1 makes false police reports against you?

My brother and his ex have been going through alot of issues surrounding the children. About 1 month ago, she was physically attacking him and broke his car window and side view mirror with a club. She then called the police and said my brother attacked her. The only thing that saved him was the childrwen telling the poilice what happened. The police told him to leave and give her space. He filled a report for his broken window but he didn't didn't want to press charges bcuz of the kids. Then on this past Monday she filled a report and got restraining order for breaking and entering eventhough he has a key to the house. They have to go to a hearing and his lawyer said the chrges will most likely be dropped.


However, I told him needed 2 file some kind of counter chrges bcuz she has made two false reports and he's missing work bcuz of this stuff. Anything he can do?

Just filing more false charges won't accomplish anything, if he does file charges make sure there is some kind of proof to back it up. Actually the police should do something because filing a false police report is in itself a crime.

I'd suggest that he should be using the fullness of his lawyer and asking him what should be done if you really want to combat these charges with more charges...





now, in my neck of the woods, it is unlikely that a charge of assault from a guy against a woman to ever carry through, especially with the woman allready makeing claims. There is a over emphasis on women battering to the point that it ignores that men can also be abused and dismisses like it's a unicorn.





Though, I'd so say that he should at least try to file for damages against his car, and this could be used to help get him child custody if he wants it... Though, again depending on where you live is sometimes impossiable for men to achieve...
