How do I deal with false reports made by an apartment neighbor?

My fiance and I recently moved into a new apartment. We reside on the second floor with our dog and cat. Our dog is about 40 pounds and within the regulation weight set by the apartment complex. We are both professional, quiet people. We don't own a television, and we don't listen to music. We go to bed at ten and wake up at seven. Our dog is always kenneled at night and never barks. We just received a letter from the apartment complex saying our downstairs neighbor has lodged a noise complaint with us. She is a student, and even by the apartment manager's description, rude and demanding. The girl complained that we stomp and bang around in the early morning. The quiet hours for the community are from 11-7, we are asleep during that time! We went down to try and talk to her politely and even offered to give her our cell phone number to call if there is a problem. She was rude, said it must be our dog (which it can't be) and admitted she doesn't know what time the banging is occuring since she sleeps until nine and doesn't bother to look at the clock. I think she is hearing us get ready, after seven, and it annoys me because I don't feel we have any recourse to prove we are not making noise. How to we defend ourselves? If she complains enough, we could get evicted!How do I deal with false reports made by an apartment neighbor?
The complainant is one person. It is her word against yours unless she has someone to back her up. I would be as assertive as possible with the manager to get some other validation as to there being a problem. She's the kind of person that would complain about the noise in your apartment even if it was vacant. Some people will b*tch about the littlest of noises. There's no satisfying people like her.
Suggest that a person, that both agree upon, to stay one night in the lady's apartment and either confirm or deny if the noises are occurring.
she is a student and when she graduates she will probably move on so just ignore her, everyone is entitled to make a little noise every now and then.
Go and speak to the apartment manager. Tell him/her everything you put on here.If I read correctly, seems like your manager has had problems with her before. If you continue to have problems with the downstairs tenant, I would suggest speaking to the apartment manager and see if it is possible to move to another apartment. Though this is easier said than done, it might be a good thing to prevent further incidences.


If not possible and you continue having problems with the neighbor, go and speak to a magistrate or a lawyer and tell them what is going on and what has happened. See what they suggest. They can better tell you what are alternatives to fix the problem.
